Common use of EVACUATION OF PREMISES Clause in Contracts

EVACUATION OF PREMISES. Should it become necessary in the judgment of REAL to evacuate the Premises for reasons of public safety, the LICENSEE will retain possession of the Premises for sufficient time to complete presentation of the activity without additional rental charge providing such time does not interfere with another event scheduled in the Premises. If it is not possible to complete presentation of the Event, or reschedule, the rental shall be forfeited, prorated, or adjusted at the discretion of REAL, based on the situation, and the LICENSEE hereby waives any claim for damages or compensation from REAL, provided, however, that LICENSEE approves such forfeiture, reduction or adjustment in writing. If the LICENSEE does not approve, it may refer the matter to dispute resolution pursuant to Section 55 of this Appendix.
