Common use of Evaluation of Contractor Clause in Contracts

Evaluation of Contractor. Pursuant to Public Contract Code Section 10369, the Staff shall evaluate Contractor's performance under the terms and conditions of this Agreement within sixty (60) days after the completion of Contractor's performance under this Agreement. If the evaluation indicates unsatisfactory performance, a copy will be sent to the Department of General Services, the Office of Legal Services and to the Contractor who may file a response to the evaluation. The evaluation and response shall remain on file for thirty-six (36) months and shall not be public records.

Evaluation of Contractor. Pursuant to Public Contract Code Section 10369, the Staff shall evaluate Contractor's performance under the terms sections 10367 and conditions of this Agreement 10369 within sixty (60) days after the completion of this Agreement, the State shall complete a written evaluation of Contractor's ’s performance under this Agreement. If this Agreement is a contract for consultant services and if Contractor did not satisfactorily perform the evaluation indicates unsatisfactory performancework, a copy of the evaluation will be sent to the Department of General Services, the DGS Office of Legal Services Services, and to the Contractor who may file a response to within fifteen (15) working days of the evaluation. The completion of the evaluation and response shall remain on file for thirty-six (36) months and shall not be public recordsin accordance with Public Contract Code section 10371.
