Events of deficiency. A. Each of the following shall constitute an event of deficiency ("Contractor deficiency"): 1. Contractor fails to perform its obligations under Section 9.05 F 2, “Vehicle Weight” of this agreement and is cited by a law enforcement agency as overweight more than once in any three-month period of any year. 2. Contractor fails to perform its obligations under Article 10 of this agreement by failing to submit reports as required in Article 10.
