Exceeding of Capacity and Overrun Fee. (1) In accordance with the procedure defined in the Operating Manual the customer may use non-contractual capacities (exceeding of capacity). Aforementioned sentence 1 shall not be deemed to create an entitlement for use of capacities beyond the contractually agreed capacities. (2) VGS shall charge for every exceeding of capacity an overrun fee of the following amount:
