Common use of Excess Surface Moisture Clause in Contracts

Excess Surface Moisture. (i) In the event that monthly weighted average Surface Moisture in Coal exceeds seven percent (7%) during the months from October to May and nine percent (9%) during the months from June to September, the Coal quantities delivered to the Purchaser during such month shall be adjusted for the resultant excess Surface Moisture, which shall be calculated in percentage by which the Surface Moisture exceeds the foregoing limits. (ii) The seller shall give regular credit note on account of excess Surface moisture, as per clause 10.2(i) above, calculated at the rate of Base Price of Analyzed Grade of coal and other charges, pursuant to clause 9.2 but excluding statutory charges pursuant to clause 9.3, if any, and railway freight for the quantity of excess Surface Moisture. (iii) Sampling/ analysis and determination of Surface Moisture for compensation shall be done as per the procedure given in Schedule V.

(iii) Sampling/ analysis and determination of Surface Moisture for compensation shall be done as per the procedure given in Schedule V.
