Common use of Exchange Stock Market Clearance Clause in Contracts

Exchange Stock Market Clearance. On the Closing Date, the Closing Shares and the shares of Common Stock issuable upon exercise of the Pre-Funded Warrants, the Traditional Warrants and the Representatives’ Warrant shall have been approved for listing on the Exchange, subject only to official notice of issuance. On each Option Closing Date (if any), the Option Shares and the shares of Common Stock issuable upon exercise of the Option Warrants (if any) and shall have been approved for listing on the Exchange, subject only to official notice of issuance.

Exchange Stock Market Clearance. On the Closing Date, the Closing Shares and the shares of Common Stock issuable upon exercise of included in the Pre-Funded WarrantsFirm Securities, the Traditional Warrants Preferred Conversion Shares, the Representative’s Warrant Shares and the Representatives’ Warrant Shares, shall have been approved for listing on the Exchange, subject only to official notice of issuance. On each the first Option Closing Date (if any), the Option Shares and the shares of Common Stock issuable upon exercise of the Option Warrants (if any) and Warrant Shares shall have been approved for listing on the Exchange, subject only to official notice of issuance.
