Common use of Exclusionary Rule Clause in Contracts

Exclusionary Rule. If within ten (10) days from receipt of the first level decision and prior to the second level hearing, the Union requests a written document(s) that was in METRO’s possession, and it is not provided, then METRO shall be excluded from using it in arbitration.
