Common use of Execution and Recording Clause in Contracts

Execution and Recording. The Land Owner has executed and acknowledged this Agreement. Not later than ten (10) days after the Adoption Date, the City shall execute and acknowledge this Agreement. Not later than ten (10) days after the Effective Date, the City Clerk shall cause recordation of this Agreement with the San Mateo County Recorder against the Property, provided that a referendum applicable to the Enacting Ordinance has not been timely submitted to the City.

Regardless, the failure to record this Agreement within the time period provided for in Government Code Section 65868.5 shall not affect its validity or enforceability between the Parties.
