Common use of Execution by Parties Clause in Contracts

Execution by Parties. Lessor and Lessee duly execute this Addendum on the respective dates written below. By executing this Addendum, LESSEE ACKNOWLEDGES HAVING READ AND AGREED TO ALL THE PROVISIONS OF THIS ADDENDUM. Lessee further acknowledges having received a copy of this Addendum. Lessee also acknowledges consulting with, or having had the opportunity to consult with, counsel prior to executing this Addendum. LESSOR: Xxxx Xxxxx LLC agrees, that any breach by Guarantor of any term or condition of this Guaranty and its subparts shall be deemed a material default of this Guaranty and Addendum and shall simultaneously constitute Lessee’s default of the Lease.
