Execution of Concession Agreement. After acknowledgement of the LoA as aforesaid by the Preferred Bidder and receipt of the Upfront Premium Cum Reimbursement of Project Development Expenses, the SJDA shall communicate to the Preferred bidder the date of signing the Concession Agreement which shall be within a period of next 30 (Thirty) days. The Preferred Bidder shall not be entitled to seek any deviation in the Agreement. If the Preferred Bidder fails to submit the Performance Security and fails to sign the Agreement, its Proposal Security shall be forfeited by SJDA.
