FORMATION OF CONTRACT. This proposed purchase contract, which incorporates by reference these General Provisions and all other terms and conditions set forth in this proposed purchase contract (collectively, the “Contract”), is Buyer's offer to purchase the services and any related goods, materials, and/or other deliverables (collectively, the “Services”) described in this offer. Acceptance is strictly limited to the terms and conditions included in this offer. Unless specifically agreed to in writing by Xxxxx's Authorized Procurement Representative, Xxxxx objects to, and is not bound by, any term or condition that differs from or adds to this offer. Seller's commencement of performance or acceptance of this offer in any manner shall conclusively evidence acceptance of this offer as written. Seller’s provision of the Services shall be governed solely by this Contract. Xxxxx and Seller are referred to herein as a “Party” or collectively as the “Parties.”
FORMATION OF CONTRACT. Your clicking ‘buy’ or ‘sell’ on the Trading Platform will send a message to us indicating that you wish to trade on the Product indicated. This message will constitute an offer by you to buy or sell at the price and trade size chosen. If we accept the trade, we will send you a Confirmation on the Trading Platform to this effect. Your trade will not have been placed and no Contract will come into existence until a Confirmation is generated on the Trading Platform. You must wait for the Confirmation to appear after clicking ‘buy’ or ‘sell’ and should you not receive the Confirmation within two (2) minutes you must notify us immediately. If you do not receive a Confirmation and you do not notify us as required, you will be deemed to have agreed only to the transactions recorded by us. Similarly, if you dispute the contents of any Confirmation sent by us to you, you must notify us immediately upon receipt by email or telephone; if you do not, the transactions recorded by us will be deemed to have been agreed by you.

FORMATION OF CONTRACT. This is Xxxxx’s offer to purchase the Goods described in this Contract. Acceptance is strictly limited to the terms and conditions included in this document. Buyer objects to, and is not bound by, any term or condition that differs from or adds to this offer, unless specifically agreed to in writing by Xxxxx’s Authorized Procurement Representative. Seller’s acceptance of this offer shall be evidenced by commencement of performance or by acceptance of this offer in writing.
FORMATION OF CONTRACT. 1.1 By signing and returning this Order Form (Part A), the Supplier agrees to enter into a Call- Off Contract with the Buyer.
1.2 The Parties agree that they have read the Order Form (Part A) and the Call-Off Contract terms and by signing below agree to be bound by this Call-Off Contract.
1.3 This Call-Off Contract will be formed when the Buyer acknowledges receipt of the signed copy of the Order Form from the Supplier.
1.4 In cases of any ambiguity or conflict, the terms and conditions of the Call-Off Contract (Part B) and Order Form (Part A) will supersede those of the Supplier Terms and Conditions as per the order of precedence set out in clause 8.3 of the Framework Agreement.
FORMATION OF CONTRACT. By performing under this Purchase Order (in full or in part), Supplier agrees to and accepts all the provisions in this Purchase Order and agrees to perform. This Purchase Order is hereby accepted on the terms set forth herein and these terms shall govern. This Purchase Order may not be modified, amended, or in any way varied with any additional or different terms unless the University specifically and expressly agrees in writing that such other terms are accepted.
FORMATION OF CONTRACT. (13.1) The Customer shall enter into a Contract by sending this Order Form to the Supplier for the provision of the Goods and Services referred to in the Order Form.

FORMATION OF CONTRACT. A. The student resident (“resident”) agrees to comply with the University Housing Contract Terms and rules and regulations as outlined in the Resident Handbook, available online at xxxxxxx.xxx.xxx/xxxxxxxx.
B. This contract is binding when accepted by University Housing.
C. This contract is for the entire academic year or balance thereof. Opening and closing dates are online at xxxxxxx.xxx.xxx/xxxxxxxx.
D. The residence halls will be closed between semesters and during University breaks, with the exception of designated break housing. On-campus apartments will remain open. Summer semester is not included in this contract.
E. Rates are subject to approval by the SIU Board of Trustees and are available online at xxxxxxx.xxx.xxx/xxxxx.

Xxxxx and Seller are referred to herein as a “Party” or collectively as the “Parties”.
