Common use of Expiration of Services Clause in Contracts

Expiration of Services. Notwithstanding any other term or condition of this Agreement, Customer’s failure or inability: (i) in any Contract Year to deliver Customer’s Maximum LNG Reception Quantity to SABINE; or (ii) on any day to take Gas for redelivery at the Delivery Point at the rate nominated in accordance with Section 5.3(a), including any portion of the Services not used in connection with a Partial Assignment, shall not serve to increase or decrease the Services to which Customer is entitled under Section 3.1(b) in any subsequent time period.

Expiration of Services. Notwithstanding any other term or condition of this AgreementAgreement other than Section 4.3, Customer’s failure or inability: (i) in any Contract Year to deliver utilize Customer’s Maximum LNG Reception Quantity to SABINETransfer Quantity; or (ii) on any day to take Gas for redelivery at the Gas Delivery Point at the rate nominated in accordance with Section 5.3(a), including any portion of the Services not used in connection with a Partial Assignment, shall not serve to increase or decrease the Services to which Customer is entitled under Section 3.1(b) in any subsequent time period.

Expiration of Services.
