Other Customers. Nothing in this Agreement shall prevent the Manager or any officer thereof from acting as investment adviser, sub-adviser, administrator or manager for any other person, firm, or corporation, and shall not in any way limit or restrict the Manager or any of its officers, members or employees from buying, selling or trading any securities for its own or their own accounts or for the accounts of others for whom it or they may be acting, provided, however, that the Manager expressly represents that it will undertake no activities which, in its judgment, will adversely affect the performance of its obligations under this Agreement.
Other Customers. Nothing in this Agreement shall be construed to prevent or prohibit Operator from providing the same or similar services as the Services to any Person not a Party to this Agreement.
Other Customers. In addition to the foregoing, Distributor may market to any other potential customer in the Territory defined under EXHIBIT A, provided customer is not already or does not prospectively become a customer of the Company and provided that Distributor is otherwise in compliance with the terms of this Agreement. These customers may include Med Spas and Aesthetics providers that the Distributor obtains provided such customers are not already customers of the Company. For the avoidance of doubt, a Person that is already a customer of the Company means a Person (including medical groups, individual physicians, and their respective affiliated franchises or organizations) that demonstrates a history and/or pattern of purchasing the Products from Company. In an effort the avoid channel conflicts, Distributor agrees to provide written notice to Company prior to, or, to the extent advance written notice is not possible, as soon as practicable after, Distributor enters into an agreement with a new customer.
Other Customers. Comment: curtailing supply to transit Users before Users providing gas to the Greek market is discriminatory and contrary to the strict requirement in the Gas Directive to treat all system users alike. All Users with firm capacity contracts should be have their capacity curtailed pro rata their nominations. Within ten (10) days from the beginning of each Year, the Operator publicises all the Reserved Transmission Capacity, by category of the Disruption Sequence List, reserved by Transmission Users according to currently applying Transmission Agreements, and the capacity it suspended because of a Case of Emergency during the preceding Year.
Other Customers. Following the commencement of shipment by C&S to customers other than A&P from the Facilities, the parties will follow the standard credit policy attached as Schedule 5.5(b).
Other Customers. 8.1 JVCo shall be entitled to provide the Services (or services similar in nature to the Services) to individuals, bodies or organisations other than the Customer.
Other Customers. 2 For purposes of assuring that Contractor's use of the Facilities under other contracts will not 3 adversely affect Contractor's performance under this Contract, by September 30 of each 4 year, beginning in , the Contractor shall provide a report to the County listing all 5 contracts with public and private customers which have utilized the Contractor Receiving 6 Facility and their equipment, including, but not limited to Containers and Chassis.
Other Customers. Customer acknowledges and agrees that Provider (and its affiliate(s)) may provide the System (or any similar or identical system under the same or any different brand) to other customers wherever they are located, regardless of their proximity to Customer. Customer hereby waives and agrees not to assert legal rights based on such relationships or competition.
Other Customers. Buyer understands that Broker may work with other prospective customers 30 who want to acquire the same property as Xxxxx. If Broker submits offers made by competing 31 customers, Xxxxxx will notify Buyer that a competing offer has been made, but will not disclose 32 any of the competing offer's material terms or conditions without the competing offeror’s written
Other Customers. During and after the term of this Agreement, it is understood that CTI shall have the right, in the exercise of its sole discretion, to provide services of any type to any person or entity, regardless of the industry or trade in which such person or entity may conduct any business or in connection with which such services may be provided, and that the provision of any such services by CTI shall not give rise to any liability to Customer on the part of CTI.
