Common use of Extension of Dates Clause in Contracts

Extension of Dates. Notwithstanding anything to the contrary contained in this Agreement, if Seller shall fail to deliver any document or item required pursuant to any of the terms and provisions of Article IV and/or Article V within the applicable time period required, Purchaser, at its option, shall have the right to extend the date of expiration of the Review Period and correspondingly the date of Closing by the number of days elapsing from the date such items were required to be delivered and the date such items were actually delivered to Purchaser. Nothing herein shall diminish Seller's obligation to timely furnish such items.

Nothing herein shall diminish Seller's obligation to timely furnish such items.
