Common use of EXTENT OF AGREEMENT Clause in Contracts

EXTENT OF AGREEMENT. This Agreement supersedes all prior agreements, written or oral, between Architect/Engineer and Owner and shall constitute the entire Agreement and understanding between the parties with respect to the subject matter hereof. This Agreement and each of its provisions shall be binding upon the parties and may not be waived, modified, amended or altered except by a writing signed by Owner and Architect/Engineer.

This Agreement represents the entire and integrated agreement between the Owner and the Architect and supersedes all prior negotiations, representations or agreements, either written or oral, between Architect/Engineer and Owner and shall constitute the entire Agreement and understanding between the parties with respect to the subject matter hereof. This Agreement and each of its provisions shall may be binding upon the parties and may not be waived, modified, amended or altered except only by a writing written instrument signed by both the Owner and the Architect/Engineer.

When the Drawings and Specifications are complete, written or oral, between Architect/Engineer and Owner and they shall constitute the entire Agreement and understanding between the parties with respect be identified by amendment to the subject matter hereofthis Agreement. This Agreement and each shall not be superseded by any provisions of its provisions shall be binding upon the parties documents for construction and may not be waived, modified, amended or altered except only by a writing written instrument signed by both Owner and Architect/EngineerContractor.

EXTENT OF AGREEMENT. Terms or conditions that were incorporated into Project Engineer’s proposal shall not be incorporated into this Agreement, and the parties expressly waive any such terms and conditions. This Agreement and each of its provisions shall be binding upon the parties and may not be waived, modified, amended or altered except by a writing signed by Owner and Architect/Project Engineer.
