Common use of Extent of Relief Clause in Contracts

Extent of Relief. (a) If either Party is rendered unable to perform any of its obligations under this Agreement as a result of Force Majeure, such Party shall, subject to the provisions of Clause 7 and the following provisions of this Clause 12, be excused from liability (including any requirement under this Agreement to make payment of any sum except for any sum due and owing as at the time of Force Majeure) for such non- performance to the extent that, and for as long as, such Force Majeure persists. (b) To the extent to which Force Majeure affecting the Service Provider results in a full or partial reduction in the level of the Service which the Service Provider can make available to the Customer, then the amounts payable by way of Service Fee by the Customer shall be reduced by the same proportion as the Service has been reduced as a result of Force Majeure.
