Extraordinary Maintenance. ‌ If required by the TÜV, mining authority (Bergamt), or any other responsible authorities, for reasons of technical safety or legal reasons, EWE shall temporarily restrict or suspend the Storage Service. The same shall apply if the transmission system operator demands a down- time at the Delivery Point for safety, technical, or legal reasons. Additional measures arising during the Service Period due to amendments of existing, or the adoption of new, laws, regu- lations or directives, may lead to additional restrictions during which the Storage Service is not fully or only partly available for the Storage Customer. All measures mentioned herein- above shall be deemed Extraordinary Maintenance. EWE shall inform the Storage Customer about the times for Extraordinary Maintenance as early as possible, accordingly. In the event that the Storage Service is not available for more than 144 Hours due to Ex- traordinary Maintenance, the Storage Fee shall be reduced pro rata temporis for any addi- tional Hours of non-availability (e.g. for 150 Hours of non-availability during the Service Peri- od the Storage Fee shall be reduced pro rata temporis by 6 Hours relating to the Maximum Available Hours of the Service Period after deduction of the interruptions referred to in No. 6.2).

Extraordinary Maintenance. Owner shall perform any extraordinary repairs or replacements necessary in order to maintain the Site, including extraordinary replacement of equipment, betterment, and additions. Extraordinary repairs or replacement consists of major repairs and rehabilitation involving substantial expenditures which usually are needed only at relatively long intervals of time, or are caused by such occurrences as earthquake, fire, obsolescence and, in some instances, neglect. Such items as replacement of roofs, replacement of corroded gas and heating lines, and rehabilitation of landscaping (ground-cover) would be considered in this category.
Extraordinary Maintenance. Subject to the payment of funds under this Agreement in sufficient amounts, the Authority shall perform Extraordinary Maintenance as necessary to ensure that, at a minimum, the System provides the service levels described in Section 3.7. The Authority shall make such personnel and equipment available as necessary to respond to and remediate any damage to or failure of the System or any individual System component on an as-needed basis. In the event any portion or individual components of the System are damaged due to the criminal, intentional, or negligent acts of a third party, Authority may, but is not required to, seek such recovery in its own name from such responsible parties.
Extraordinary Maintenance. The COUNTY shall provide a written request and obtain consent from the UNIVERSITY, which shall not be unreasonably withheld, when extraordinary maintenance is required. If the UNIVERSITY denies the COUNTY’s written request, the UNIVERSITY must include a written explanation for the denial and what, if any, steps the COUNTY can take to gain permission in the future. Extraordinary Maintenance. Extraordinary/emergency maintenance involves the repair or replacement of equipment damaged by vehicle collisions, vandalism, civil disorder, windstorm, natural disasters, street construction or excavation. Extraordinary/emergency maintenance also includes replacements based on obsolescence, required MUTCD updates, or other unusual factors when the labor and materials necessary to ensure the safe and efficient operation of the City’s traffic signal system goes beyond routine maintenance, as defined in Section III. Contractor shall provide extraordinary/emergency maintenance for the City’s traffic signal system and related equipment. The Contractor shall prepare and submit a work order to the City providing the details and justification for the needed repairs. The work shall be subject to City authorization and will be scheduled during regular hours whenever possible, City reserves the right to separately bid extraordinary maintenance work to other firms in the event a negotiated price or schedule of completing repairs cannot be reached which is acceptable to both parties or is deemed by the City to exceed the terms of the current Contract. Contractor may be required to assist or support other firms selected by the City as requested. Generally, extraordinary/emergency maintenance of the City’s traffic signal equipment and systems will include but not be limited to: 1. Repair and/or replacement of a failed or malfunctioning signal system caused by collisions, vandalism, civil disorder, windstorm, natural disasters, street construction or excavation. 2. Modifications to traffic signal equipment such as, but not limited to, upgrades of controller cabinets and controller components 3. Replacement of batteries for battery back-up systems

Extraordinary Maintenance. 6.2.1 Extraordinary maintenance is at the Lessor’s expense. Extraordinary maintenance includes activities that are necessary to maintain the facility’s condition for its intended use, however beyond the scope of routine maintenance. Examples of extraordinary maintenance include but not limited to replacement of floorings and roofs, replacement of heating and cooling equipment, maintenance and replacement of standby and emergency power equipment, replacement of windows, resurfacing of parking lots, and upgrade of security infrastructures. 6.2.2 In case of need or emergency and delay to act of the Lessor, the Lessee, upon notice to the Lessor, is expressly authorised to carry out extraordinary maintenance works. In that event, any amount paid by the Lessee for such works shall be deducted from the rent following the submission of the relevant invoices stating the kind of works done and their cost.
Extraordinary Maintenance. The Local Government is not required to perform any extraordinary maintenance, construction or reconstruction under this Agreement. If the Local Government is willing to perform extraordinary maintenance, and the State's District Maintenance Engineer at Mankato approves such performance, the parties to this Agreement must enter into a separate agreement therefore. No expenses may be incurred on the extraordinary maintenance prior to the full execution of such an agreement as governed by Minnesota Statutes § 16A.15, subdivision 3.
