Facility Milestones. Each Facility will have its own set of Facility Milestones. Facility Milestones will be set forth in the Facility Schedule developed as part of each Facility Implementation Plan.

Facility Milestones. Seller shall design and construct the Facility in accordance with Prudent Electrical Practice and meet each Facility Milestone as specified in the attached Exhibit C on or before the date specified for each Facility Milestone listed in the attached Exhibit C; provided, however, that the date for each Facility Milestone may be extended for Excusable Delay as provided in Section 8, and for Interconnection Delays as provided in Section 4.3. If Seller fails to achieve the Facility Milestones by the date specified in this Section 4.2 (as such date may be extended under Section 8 or Section 4.3), either Party shall have the right to terminate this Agreement without penalty or liability of either Party. A termination under this Section 4.2 shall not trigger the default provisions contained in Section 14.

  • Dimensions Education Bachelor’s or Master’s Degree in Computer Science, Information Systems, or other related field. Or equivalent work experience. Experience: A minimum of 5 years of IT work experience with demonstrated knowledge in architecture design, software development, database management systems and systems integration in multi-platform environments.

  • Notices Any notice, request or other document required or permitted to be given or delivered to the Holder by the Company shall be delivered in accordance with the notice provisions of the Purchase Agreement.

  • Assignment This Agreement and all rights and obligations hereunder may not be assigned without the written consent of the other party.
