Failure of Insurance Carrier to Provide Benefit. The failure of any carrier to provide any benefit for which it has contracted shall result in no liability to the CITY or to the UNION, nor shall such failure be considered a breach by the CITY or the UNION of any obligation undertaken pursuant to this or any other Article in this Agreement.

However, nothing contained in this Article shall be construed to relieve any insurance carrier from any liability it may have to the City, the Union, an employee, or the beneficiary of an employee. The City and the Union shall, as necessary, take appropriate steps to require and obtain contract compliance from the insurance carriers.
