Common use of Failure of Supplier to insure Clause in Contracts

Failure of Supplier to insure. If the Supplier fails to: (a) effect or to maintain any of the insurances set out in clauses 20.1; (b) have any subcontractor or assignee effect or maintain any insurances; or (c) provide evidence of insurance as required by clause 20.2(b), then XL may at the Supplier’s cost: (i) effect and maintain that insurance; (ii) pay the necessary premiums; and (iii) recover from the Supplier the amount so paid under clause (ii) or otherwise in accordance with this agreement, until the Supplier has complied with its obligations under this clause 20.
