Common use of Failure of Tenant to Purchase and Maintain Insurance Clause in Contracts

Failure of Tenant to Purchase and Maintain Insurance. If Tenant fails to obtain and maintain the insurance required herein throughout the Term of this Lease, Landlord may, but without obligation to do so, purchase the necessary insurance and pay the premiums therefor. If Landlord so elects to purchase such insurance, Tenant shall promptly pay to Landlord as Additional Rent, the amount so paid by Landlord, upon Landlord's demand therefor. In addition, Landlord may recover from Tenant, and Tenant agrees to pay as Additional Rent, any and all losses, damages, expenses and costs which Landlord may sustain or incur by reason of Tenant's failure to obtain and maintain such insurance.

If In the event Tenant fails to obtain and maintain does not purchase the insurance required herein in this Lease or keep the same in full force and effect throughout the Term term of this LeaseLease (including any renewals or extensions), Landlord may, but without obligation to do so, purchase the necessary insurance and pay the premiums therefor. If Landlord so elects to purchase such insurance, Tenant shall promptly pay to Landlord Landlord, as Additional Rentadditional rent, the amount so paid by Landlord, Landlord promptly upon Landlord's demand therefor. In addition, Landlord may recover from TenantTenant and Tenaxx xxxees to pay, and Tenant agrees to pay as Additional Rentadditional rent, any and all losses, damages, expenses Enforcement Expenses and costs damages which Landlord may sustain or incur by reason of Tenant's failure to obtain and maintain such insurance. If Tenant fails to maintain any insurance required in this Lease, Tenant shall be liable for all losses, damages and costs resulting from such failure.
