Common use of Failure of Tenant to Purchase and Maintain Insurance Clause in Contracts

Failure of Tenant to Purchase and Maintain Insurance. If Tenant fails to obtain and maintain the insurance required herein throughout the Term of this Lease, and such failure continues for more than three (3) business days following notice from Landlord, Landlord may, but without obligation to do so, purchase the necessary insurance and pay the premiums therefor. If Landlord so elects to purchase such insurance, Tenant shall promptly pay to Landlord as Additional Rent, the amount so paid by Landlord, plus an administrative fee equal to ten percent (10%) of the premium, upon Landlord’s demand therefor. In addition, Landlord may recover from Tenant and Tenant agrees to pay, as Additional Rent, any and all losses, damages, expenses and costs that Landlord may sustain or incur by reason of Tenant’s failure to obtain and maintain such insurance. 12.5
