Common use of Failure to Appeal Clause in Contracts

Failure to Appeal. If the employee against whom a recommendation for discipline has been filed fails to file a notice of appeal within the time specified in these rules, the employee shall be deemed to have waived his/her right to appeal. If the recommendation has not already been ordered into effect on an interim basis according to Section 9 o f this Article, the person making the recommendation may order the recommended disciplinary action into effect, and such action shall be reported to and made subject to ratification by the Board of Trustees. A copy of the ratified order shall be served upon the employee by registered or certified mail, return receipt requested.
