Failure to Issue a Maintenance NTP. TxDOT shall have no additional liability to any DB Contractor-Related Entity in the event that TxDOT elects, in its discretion, not to issue any Maintenance NTP under this CMC. TxDOT’s election not to issue any Maintenance NTP shall not be treated as a Termination for Convenience.
