Common use of – Failure to Reside Clause in Contracts

– Failure to Reside. The Qualifying Resident shall reside in the Unit on a full-time permanent basis as the principal residence of the Qualifying Resident and shall not, without the written consent of the Board of Directors, cease or fail to reside in the Unit on a full-time permanent basis for a period exceeding one hundred eighty (180) days per twelve (12) month period. If the Qualifying Resident shall cease or fail to reside in the Unit on a full-time permanent basis, for a period exceeding one hundred eighty (180) days, without obtaining the written consent of the Board of Directors, the Board of Directors, in their sole discretion, may determine that the Qualifying Resident has abandoned such Unit (“Abandonment”).
