Right of Occupancy. Provider will provide Resident with a space in the Residence Facility for his/her occupancy as a residence. The right of occupancy does not include the right to a specific residence space, roommate, or type of accommodation by this Agreement. University will make housing assignments on behalf of Provider subject to availability of space and without regard to race, religion, color, age, disability, national origin, or sexual orientation. Final determinations on housing assignments are in the sole discretion of University acting on behalf of Provider. No guarantee of a specific unit space assignment is implied or made.
Right of Occupancy. The Office of Housing shall provide Student with a space in a student housing facility on campus based on availability. This Agreement shall not give Student a right to any specific space, building, roommate, or type of accommodation. In the event that no space is available on the campus, University may terminate the Agreement.
Right of Occupancy. As soon as practicable after the commencement date the State will cause the Minister for Mines in exercise of the power in that behalf conferred by Section 276 of the Mining Act to temporarily reserve from occupation the land more particularly described in the “particulars of mining areas” appended to this Section and with the approval of the Governor to authorise the Joint Venturers to temporarily occupy such land (the right of the Joint Venturers so to do pursuant to such authority being hereinafter referred to as “the right of occupancy”) for the period and upon and subject to the terms and conditions hereinafter mentioned. PARTICULARS OF MINING AREAS ALL those pieces of land (containing in the aggregate an area of 322 square miles or thereabouts) being those portions of the land the subject of Temporary Reserves 4192H, 4193H, 4266H, 4267H, 4737H, 4881H, 4882H, 4883H, and 4884H, as are delineated and coloured green in the plan marked ‘A’ signed by or on behalf of the parties hereto for the purpose of identification.
Right of Occupancy. The Principal Representative shall have the right to take possession of and to use any completed or partially completed portions of the Work, even if the time for completing the entire Work or portions of the Work has not expired and even if the Work has not been finally accepted, and the Contractor shall fully cooperate with the Principal Representative to allow such possession and use. Such possession and use shall not constitute an acceptance of such portions of the Work. Prior to any occupancy of the Project, an inspection shall be made by the Principal Representative, State Buildings Program and the Contractor. Such inspection shall be made for the purpose of ensuring that the building is secure, protected by operation safety systems as designed, operable exits, power, lighting and HVAC systems, and otherwise ready for the occupancy intended and the Notice of Substantial Completion has been issued for the occupancy intended. The inspection shall also document existing finish conditions to allow assessment of any damage by occupants. The Contractor shall assist the Principal Representative in completing and executing State Form SBP-01, Approval of Occupancy/Use, prior to the Principal Representative’s possession and use. Any and all areas so occupied will be subject to a final inspection when the Contractor complies with Article 41, Completion, Final Inspection, Acceptance and Settlement.
Right of Occupancy. Failure to furnish the required completion schedule shall constitute a substantial reason for withholding the issuance of any Notice of Substantial Completion. The Contractor shall have the right to request a final inspection of any discrete physical portion of the Project when in the opinion of the Principal Representative, The Architect/Engineer and State Buildings Program a final punch list can be reasonably prepared, without confusion as to which portions of the Project are referred to in any subsequent Notice of Partial Final Settlement which might be issued after such portion is finally accepted. Discrete physical portions of the Project may be, but shall not necessarily be limited to, such portions of the Project as separate buildings where a Project consists of multiple buildings. Similarly, an addition to an existing building where the Project also calls for renovation or remodeling of the existing building may constitute a discrete physical portion of the Project. In such circumstances, when in the opinion of the Principal Representative, the Architect/Engineer and State Buildings Program, the requirements for issuance of a Notice of Substantial Completion can be satisfied with respect to the discrete portion of the Project, a partial Notice of Substantial Completion may be issued for such discrete physical portion of the Project.
Right of Occupancy. This Agreement and the right of the Qualifying Resident, and that of any person residing in the Unit, to possession or occupancy of the Unit shall terminate if the Share Ownership of the Qualifying Resident is terminated under this Agreement and/or the Governing Documents.
Right of Occupancy. Landlord agrees to furnish the Leased Premises described in paragraph 1, subject to the terms and conditions described herein; however, it shall be the responsibility of the Tenant to obtain the necessary occupancy permits required by Local, State and Federal Agencies and Tenant shall be solely responsible for any modifications or changes required to obtain such permits. In the event Tenant fails to perform any obligation under the terms of this Lease Agreement (including but not limited to cleaning in and around the Leased Premises and repairing damages to the Leased Premises) and Landlord elects to perform Tenant's obligation, then Landlord shall have the right to collect from the Tenant the actual costs incurred in performing such obligations together with the Landlord's costs of any of Landlord's employees time spent in connection therewith and 20% of all amounts described above to compensate Landlord for overhead and profit.
Right of Occupancy. 16.1.1 Subject to the provisions of paragraph 11.4.2, the Principal Representative shall have the right to take possession of and to use any completed or partially completed portions of the Work, even if the time for Completion of the Work or such portions of the Work has not expired and even if the Work has not been finally accepted. Such possession and use shall not constitute an acceptance of such portions of the Work.
Right of Occupancy. This Contract shall be governed by the laws of the United States and the State of Georgia, the rules and regulations of the Board of Regents of the University System of Georgia, and the rules and regulations of Xxxxxxx State University.
Right of Occupancy. Resident shall have the right to occupy the Residence at Messiah Village for so long as Resident satisfies the Conditions of Occupancy. Continued Occupancy of the Residence shall, in general, be controlled by Resident’s physical and mental condition. Resident will abide by Messiah Village’s Transfer Guideline Policy (See Section 10.5. “The Messiah Village Continuum” of this Agreement and Attachment A).
