Fair Right of Use. The Software may contain certain information published by third parties which CAP/PSP reasonably and in good faith considers to be in the public domain. In the event that a third party should contest such fair right of use, You agree to abide by any order or injunction that may be obtained which may preclude usage of such information. While CAP/PSP will endeavour to resolve future right of use for this information, we do not warrant that any such right of use will be granted by the third party nor will CAP/PSP be held liable in any way for any direct or consequential damage caused to You by an inability to use The Software.

  • IN WITNESS WHEREOF the parties hereto have executed this Agreement as of the date first above written.
