FERPA Compliance and Confidentiality of Student Education Records. and Personally Identifiable Information (“PII”). 6.1 The Parties shall comply with the Family Education Rights and Privacy Act (FERPA) with regard to collection and use of Student Education Records. Authorized employees of the Parties will have access to Student Education Records as defined under FERPA for eligible transfer students. 6.2 Institution shall use reasonable efforts to implement appropriate reasonable physical, administrative, and technical safeguards to prevent unauthorized use or disclosure of Student Education Records. Such measures will be no less protective than those used to secure Institution’s own data of a similar type and in no event less than reasonable in view of the type and nature of the data involved.
