Common use of Fiduciary Relationship Clause in Contracts

Design/Builder recognizes and accepts a fiduciary relationship of trust and confidence established between Design/Builder and Owner by this Agreement and agrees that it shall at all times in good faith use its best efforts to advance Owner’s interests and agrees to perform the Design Services and the Work in the best professional manner.
