Filling Vacancies or Assignments. Where it is determined by the Employer that: (a) two or more bargaining unit applicants for a position in a bargaining unit are qualified; and (b) those applicants are of equal merit, preference in filling the vacancy or Assignment shall be given to the applicant with the greatest length of seniority. Notwithstanding the above, the Employer may award the position to the most senior applicant without conducting interviews.
