Final Fairness and Approval Hearing. The Parties shall petition the Court to hold a Final Fairness and Approval Hearing. At the Final Fairness and Approval Hearing, the Court will review any objections to the settlement with the Parties and any Plaintiff Class Member who chooses timely to appear. The Parties have the right to present arguments and evidence regarding such objections, if any. To be heard at the hearing, a Plaintiff Class Member must file and serve any objections on Plaintiff’s counsel and Defendant’s counsel so that they are received by each no later than sixty (60) days from the original mailing of Class Notice. Final Fairness and Approval Hearing. On the date set forth in the Order Granting Preliminary Approval of Class Settlement, a Final Fairness and Approval Hearing shall be held before the Court in order to review this Agreement and determine whether the Court should give final approval. The Final Fairness and Approval Hearing shall be set for approximately 100 days after the Court’s Order Granting Preliminary Approval, subject to the Court’s availability. Class Counsel shall file a motion for Final Approval at least seven (7) days in advance of the Final Fairness and Approval Hearing. At the Final Fairness and Approval Hearing, the Parties shall ask the Court to grant final approval to this Agreement. If the Parties’ request for final approval is granted, a Final Order Approving Settlement of Class Action and Dismissal with Prejudice subject to full compliance with the Settlement Agreement shall be entered.
