FINAL RESOLUTION for LOCALLY-FUNDED AGREEMENTS. If the Agreement is funded in whole with funds provided by a city or county board of education or other local governmental authority and the Agreement does not stipulate a binding alternative dispute resolution method, the final resolution of Claims and Disputes which cannot be resolved by the Architect and Owner may be by any legal remedy available to the parties. Alternatively, upon the written agreement of the Architect and the Owner, final Resolution of Claims and Disputes may be by submission to binding arbitration before a neutral arbitrator or panel or by submission to the Director in accordance with preceding Paragraph D.
