FIRST. Landlord Unless the context otherwise clearly indicates a contrary intent or unless specifically provided herein, each term used in this Agreement which is defined in the Lease shall not be liable for failure deemed to give have the meaning ascribed to such term in the Lease. SECOND: For a term commencing as of the date Tenant takes possession of the premises upon commencement date by reason of Eleventh Amendment Added Spaces (“11th Amend Com Date” or “CD”) through and including July 31, 2016, unless sooner terminated in accordance with terms set forth herein or in the fact Lease, there shall be added to and included in the Existing Premises, the Eleventh Amendment Added Spaces in the Building, so that premises are the term “demised premises” as defined in the Lease shall mean collectively, the Existing Premises and the Eleventh Amendment Added Spaces. Except as otherwise expressly set forth herein, Landlord has not ready for occupancy, or due made any representations as to a prior Tenant wrongfully holding over the physical condition or any other person wrongfully in possession matter affecting or relating to the Eleventh Amendment Added Spaces and Tenant specifically acknowledges that and agrees that no such representation has been made. Tenant further acknowledges that Landlord has afforded Tenant the opportunity for any other reason: in such event the rent shall not commence until possession is given or is availablea full and complete investigation, but the term herein shall not be extended.
