FIRST. Landlord shall not be liable for failure to give possession of the premises upon commencement date by reason of the fact that premises are not ready for occupancy, or due to a prior Tenant wrongfully holding over or any other person wrongfully in possession or for any other reason: in such event the rent shall not commence until possession is given or is available, but the term herein shall not be extended. In any action or proceeding wherein the Landlord and the Tenant are parties, a schedule or "make up" of rate for the building on the demised premises, purporting to have been issued by New York Fire Insurance Exchange, or other body making fire insurance rates for the demised premises, shall be prima facie evidence of the facts therein stated and of the several items and charges included in the fire insurance rate then applicable to the demised premises. WATER RENT SEWER TWENTY-FOURTH.--If a separate water meter be installed for the demised premises, or any part thereof, the Tenant will keep the same in repair and pay the charges made by the municipality or water supply company for or in respect to the consumption of water, as and when bills therefor are rendered. If the demised premises, or any part thereof, be supplied with water through a meter which supplies other premises, the Tenant will pay to the Landlord, as and when bills are rendered therefor, the Tenant's proportionate part of all charges which the municipality or water supply company shall made for all water consumed through said meter, as indicated by said meter. Such proportionate part shall be fixed by apportioning the respective charge according to floor area against all of the rentable floor area in the building (exclusive of the basement) which shall have been occupied during the period of the respective charges, taking into account the period that each part of such area was occupied. FIRST. Landlord Unless the context otherwise clearly indicates a contrary intent or unless specifically provided herein, each term used in this Agreement which is defined in the Lease shall not be liable for failure deemed to give have the meaning ascribed to such term in the Lease. SECOND: For a term commencing as of the date Tenant takes possession of the premises upon commencement date by reason of Eleventh Amendment Added Spaces (“11th Amend Com Date” or “CD”) through and including July 31, 2016, unless sooner terminated in accordance with terms set forth herein or in the fact Lease, there shall be added to and included in the Existing Premises, the Eleventh Amendment Added Spaces in the Building, so that premises are the term “demised premises” as defined in the Lease shall mean collectively, the Existing Premises and the Eleventh Amendment Added Spaces. Except as otherwise expressly set forth herein, Landlord has not ready for occupancy, or due made any representations as to a prior Tenant wrongfully holding over the physical condition or any other person wrongfully in possession matter affecting or relating to the Eleventh Amendment Added Spaces and Tenant specifically acknowledges that and agrees that no such representation has been made. Tenant further acknowledges that Landlord has afforded Tenant the opportunity for any other reason: in such event the rent shall not commence until possession is given or is availablea full and complete investigation, but the term herein shall not be extended. THE TENANT FURTHER COVENANTS: IF A FIRST FLOOR TWENTY-SECOND.--If the demised premises or any part thereof consist of a store, or of a first floor, or of any part thereof, the Tenant will keep the sidewalk examination and curb in front thereof clean at all times and free from snow and ice, and will keep insured in favor inspection of the LandlordEleventh Amendment Added Spaces and Tenant agrees, all plate glass therein that except as set forth in Sections ELEVENTH and furnish the Landlord with policies of insurance covering the same.
