Fiscal Agent Services. The County agrees to serve as Fiscal Agent for the Authority starting , 20 , and specifically agrees to provide the following services in that capacity:
a. Receive, manage and distribute revenues transferred to the Authority. The Treasurer of the County will invest any funds not disbursed to the localities in an account or accounts separate from County funds in accordance with Authority policies and procedures. Interest earnings will be accounted for separately and reported out on at least an annual basis. All approvals for disbursement of locality specific funds or funds held in the separately established regional account shall be in accordance with the Authority’s approved financial policies and procedures. The associated accounts described herein will be provided through the County’s banking services contract.
b. Provide financial advisory services to the Authority on an as needed basis via the County’s contract for advisory services.
Fiscal Agent Services. The City agrees tomay serve as Fiscal Agent for the Authority starting , 20 , and specifically agrees tomay provide the following services in that capacity:
a. Review and maintain accounting records, preliminary findings, notes of analysis, bank reconciliations, and monthly/quarterly financial statements of the Authority’s assets, liabilities, equity, revenue, expenses, estimated revenues, budgeted expenses and commitments. The City will may monitor, and assist the Authority in ensuring, the Authority’s compliance with generally accepted accounting principles and all applicable state and federal guidelines.
b. Serve as a contact to the Office of the Auditor of Public Accounts for the Authority’s annual financial audit process. This section includes the City providingThe City may provide information to the auditor retained by the Office of the Auditor of Public Accounts, preparing and meeting with the auditor to review the preliminary audit report, and publishing audited financial statements for the Authority. The Authority shall pay all costs associated the publishing of the Authority’s audited financial statements.
Fiscal Agent Services. The County agrees to serve as Fiscal Agent for the Authority starting July 1, 1998, and specifically agrees to provide the following services in that capacity:
a. Monitor the investment and disbursement of funds held by the Trustee from revenue bonds issued for expansion and construction of the Richmond Centre. The County will reconcile financial records maintained for the Authority with the records maintained by the Trustee.
b. Receive and manage revenues transferred on behalf of the Authority to the Treasurer of the County. The Treasurer of the County will invest these funds in an account separate from County funds in accordance with the Investment Policy established by the Treasurer of the County. Interest earnings will be reported to the Authority’s Finance Committee and to the Authority’s Commission monthly. Before payment is made from these funds, an invoice must be forwarded from the Authority to the County to authorize payment. The County will determine that funds are budgeted and available prior to disbursement. All approvals for payment shall be in accordance with the Authority’s resolution adopted on July 9, 1998 entitled “Designating Chief Administrative Officer, Delegating Certain General Administrative Authority to such Chief Administrative Officer and Specifically Granting Invoice Payment Authority to such Chief Administrative Officer and to Certain other Officers.”
c. Maintain accounting records for the Authority in accordance with generally accepted accounting principles to reflect the Authority’s assets, liabilities, equity, revenue, expenses, estimated revenues, budgeted expenses and commitments as appropriate and will report monthly to the Authority’s Finance Committee and to the Authority’s Commission on the Authority’s financial status as well as prepare special reports as appropriate.
d. Provide information to the auditor retained by the Authority, prepare and meet with the auditor to review the preliminary audit report and publish audited financial statements for the Authority. The County will be responsible for ensuring compliance with generally accepted accounting principles and all state and federal guidelines.
e. Provide risk management services which include securing necessary insurance and assisting with claims. Secure arbitrage reporting, financial advisory services and audit services.
f. Monitor and ensure financial compliance with various legal agreements of the Authority. This includes, but not restricted to, the following...
Fiscal Agent Services. The City shall continue to serve as the Fiscal Agent to the CRRMA for all funds held by the City hold CRRMA funds on behalf of the CRRMA. Notwithstanding anything to the contrary, the responsibilities of the City as “Fiscal Agent” are strictly limited to the duties described under this Section II(C). The City shall deposit and hold such funds separately from City funds. Except where the CRRMA has engaged a trustee or agent to manage CRRMA funds, the City shall invest CRRMA funds held by the 14-1015-008.001 | 950197 | 2020-CRRMA Management Agreement | OAR Page 2 of 10 City in accordance with the City’s Investment Policy, as amended. The City shall deposit all investment proceeds and revenue funds forwarded to the City on behalf of the CRRMA in the referenced separate CRRMA accounts. The City shall serve in a fiduciary capacity in performing the Fiscal Agent services, and shall provide the CRRMA quarterly accounts of funds and investments. The City shall make all payments to vendors, debt service payments of debts incurred by the CRRMA and shall transfer funds between CRRMA accounts; provided that such action is expressly authorized in writing by an authorized representative of the CRRMA. The City has no duty to verify the accuracy of a request for a disbursement of funds or other action under this Agreement that has been authorized in writing by an authorized representative of the CRRMA. For purposes of this Agreement, the CRRMA designates its ED and DF as the CRRMA’s authorized representatives. If the CRRMA wishes to designate an additional person as an authorized representative, then the CRRMA will forward to the City a duly authorized resolution of the CRRMA board confirming such designation of authority.
