Common use of Flood Insurance Protection Clause in Contracts

Flood Insurance Protection. If the facility providing services under this Contract is located in an area that has been identified by the Federal Emergency Management Agency (FEMA) as having special flood hazards, the Project Sponsor will ensure that flood insurance on the structure is obtained in compliance with section 102(a) of the Flood Disaster Protection Act of 1973 (42 U.S.C. 4001 et seq.). Evidence of such insurance shall be provided to the Agent upon request.

If the facility providing services under this Contract Agreement or a Project Sponsor’s facility providing services under a contract with the Administrative Agent is located in an area that has been identified by the Federal Emergency Management Agency (FEMA) as having special flood hazards, the Project Sponsor Agent will ensure that flood insurance on the structure is obtained in compliance with section 102(a) of the Flood Disaster Protection Act of 1973 (42 U.S.C. 4001 et seq.). Evidence of such insurance shall be provided to the Agent upon request.
