Common use of FLOOR LOAD - HEAVY MACHINERY Clause in Contracts

FLOOR LOAD - HEAVY MACHINERY. Tenant shall not place a load upon any floor in the Premises exceeding the lesser of (a) the floor load per square foot of area which such floor was designed to carry as certified by Landlord's architect and (b) the floor load per square foot of area which is allowed by law. Landlord reserves the right to prescribe the weight and position of all business machines and mechanical equipment, including scales, which shall be placed so as to distribute the weight. Business machines and mechanical equipment shall be placed and maintained by Tenant at Tenant's expense in settings sufficient, in Landlord's judgment, to absorb and prevent vibration, noise and annoyance. Tenant shall not move any safe, heavy machinery, heavy equipment, freight, bulky matter or fixtures into or out of the Building without Landlord's prior consent. If such safe, machinery, equipment, freight, bulky matter or fixtures requires special handling, Txxxxx agrees to employ only persons holding a Master Rxxxxx's License to do said work, and that all work in connection therewith shall comply with applicable laws and regulations. Any such moving shall be at the sole risk and hazard of Tenant and Tenant will exonerate, indemnify and save Landlord harmless against and from any liability, loss, injury, claim or suit resulting directly or indirectly from such moving. Tenant shall schedule such moving at such times as Landlord shall require for the convenience of the normal operations of the Building.

Business machines and mechanical equipment shall be placed and maintained by Tenant Sublessee at TenantSublessee's expense in settings sufficient, in LandlordSublessor's judgment, to absorb and prevent vibration, noise and annoyance. Tenant Sublessee shall not move any safe, heavy machinery, heavy equipment, freight, bulky matter or fixtures into or out of the Building without LandlordSublessor's prior consent, which consent may include a requirement to provide insurance, naming Sublessor as an insured, in such amounts as Sublessor may deem reasonable. (b) If such safe, machinery, equipment, freight, bulky matter or fixtures requires special handling, Txxxxx Sublessee agrees to employ only persons holding a Master RxxxxxXxxxxx's License to do said such work, and that all work in connection therewith shall comply with applicable laws and regulations. Any such moving shall be at the sole risk and hazard of Tenant Sublessee, and Tenant Sublessee will exonerate, indemnify indemnity and save Landlord Sublessor harmless against and from any liability, loss, injury, claim or suit resulting directly or indirectly from such moving. Tenant shall schedule such moving at such times as Landlord shall require for the convenience of the normal operations of the Building.14.5

Tenant shall not move any safe, heavy machinery, heavy equipment, freight, bulky matter matter, or fixtures into or out of the Building without Landlord's ’s prior written consent, which consent shall not be unreasonably withheld, conditioned or delayed. If such safe, machinery, equipment, freight, bulky matter or fixtures requires special handling, Txxxxx Tenant agrees to employ only persons holding a Master Rxxxxx's Rigger’s License to do said work, and that all work in connection therewith shall comply with applicable laws and regulationsLegal Requirements. Any such moving shall be at the sole risk and hazard of Tenant and Tenant will exoneratedefend, indemnify and save hold Landlord harmless against and from any liability, loss, injury, claim or suit resulting directly or indirectly from such moving, except to the extent caused by the negligence or willful misconduct of Landlord or its employees, agents or contractors. Tenant Proper placement of all such heavy machinery and mechanical equipment in the Premises shall schedule such moving at such times as Landlord shall require for the convenience of the normal operations of the Buildingbe Tenant’s responsibility.

Tenant shall not move any safe, heavy machinery, heavy equipment, freight, bulky matter or fixtures (collectively, "HEAVY EQUIPMENT") into or out of the Building without giving Landlord prior written notice thereof and observing all of Landlord's prior consentRules and Regulations with respect to the same. If such safe, machinery, equipment, freight, bulky matter or fixtures Heavy Equipment requires special handling, Txxxxx Tenant agrees to employ only persons holding a Master RxxxxxRigger's License to do said work, and that all work in connection therewith shall comply with applicable laws and regulationsLegal Requirements. Any such moving shall be at the sole risk and hazard of Tenant and Tenant will exoneratedefend, indemnify and save the Landlord Indemnitees harmless from and against any and from any liability, loss, injury, claim or suit all Claims resulting directly or indirectly from such moving. Tenant Proper placement of all Heavy Equipment in the Premises shall schedule such moving at such times as Landlord shall require for the convenience of the normal operations of the Buildingbe Tenant's responsibility.
