Common use of Forfeiture of Severance Benefits Clause in Contracts

Forfeiture of Severance Benefits. The Executive shall forfeit the right to receive the Severance Benefits (other than the benefits described in Section 2.05) if the Executive breaches any of the covenants set forth in Section 3. If the Executive breaches any of the covenants set forth in Section 3, the Executive shall be liable to the Company for the repayment of any Severance Benefits (other than the benefits described in Section 2.05) previously paid to the Executive.

Forfeiture of Severance Benefits. The Executive shall forfeit the right to receive the Severance Benefits (other than the benefits described in Section 2.05) if the Executive breaches any of the covenants set forth in Section 3. If the Executive breaches any of the covenants set forth in Section 3, the Existing Covenants Executive shall be liable to the Company for the repayment of any Severance Benefits (other than the benefits described in Section 2.052.04) previously paid to the Executive.

If the Executive materially breaches any of the covenants set forth in Section 3, the Executive 3 he shall be liable to the Company for the repayment of any Severance Benefits (other than the benefits described in Section 2.052.07) previously paid to the Executivehim.
