Formal Appeals. NAD hears formal appeals on final technical determinations and program decisions (7 CFR Sections 614.8(b)(2) and 614.9(a)(4)). NAD conducts hearings to afford a participant the opportunity to present testimony or documentary evidence or both in order to have a previous determination or decision reversed and demonstrate why an adverse decision was in error.
