Common use of FRINGE BENEFIT REMEDIES Clause in Contracts

FRINGE BENEFIT REMEDIES. (a) The failure of an individual Employer to comply with the provisions of Section 6.01 through 6.06 shall also constitute a breach of this labor Agreement. As a remedy for such a violation, the parties to this agreement, the Labor-Management Committee and/or the Council on Industrial Relations for the Electrical Contracting Industry, as the case may be, are empowered, at the request of the Union, to require an Employer to pay into the affected Joint Trust Funds established under this Agreement any delinquent contribution to such funds which have resulted from the violation.
