Hours - Wages - Working Conditions. HOURS: (WORKDAY/WORKWEEK) Section 3.01 The normal workday shall consist of the eight (8) hours between 7:00 AM. and 3:30 P.M. with thirty (30) minutes for lunch. Midway through the shift there shall be a lunch break. Job starting time may be adjusted up to one (l) hour prior to, or one (1) hour after, the regular starting time with the approval of the majority of the workers and the Business Manager. (a) Eight (8) consecutive hours work between the hours of 5:00 A.M. and 6:00 P.M. (excluding a meal period of not less than one-half (1/2) hour) shall constitute a work day. Forty (40) hours within five (5) consecutive days, Monday through Friday, shall constitute the workweek. A xxxxxxx required to work during his regular lunch period shall receive the established overtime rate for lunch period and shall be allowed a reasonable opportunity to eat his lunch on the employer’s time. A thirty-(30)-minute lunch period shall be allowed no later than six (6) hours after the regular start time.
(1) Every employer shall authorize and permit all employees to take rest periods, which insofar as practicable shall be in the middle of each work period. Nothing in this provision shall prevent an employer from staggering rest periods to avoid interruption in the flow of work and to maintain continuous operations, or from scheduling rest periods to coincide with breaks in the flow of work that occur in the course of the workday. The authorized rest period time shall be based on the total hours worked daily at the rate of ten (10) minutes net rest time for every four (4) hours worked, or major fraction thereof. Rest periods shall take place at employer designated areas, which may include or be limited to the employees’ immediate work area.
(2) Rest periods need not be authorized in limited circumstances when the disruption of continuous operations would jeopardize the product or process of the work. However, the employer shall make up the missed rest period within the same workday or compensate the employee for the missed ten (10) minutes of rest time at his/her regular rate of pay within the same pay period.
(3) A rest period need not be authorized for employees whose total daily work time is less than three and one-half (3 ½) hours. Authorized rest period time shall be counted as hours worked for which there shall be no deduction from wages.
(4) If an employer fails to provide an employee a rest period in accordance with the applicable provisions of this order, the employer shall pay the employee one (1) hour of pay at the employee’s regular rate of compensation for each workday that the rest period is not provided.
(5) The contactor may implement the rest periods described in Section 3.01 (b) in any manner consistent with the California Department of Industrial Relations’ interpretation for implementing rest periods under Industrial Wage Order 16.

The Employer may change the starting time of any job or shift by one hour earlier.

Section 3.03 All work performed outside the regularly scheduled working hours and on Saturdays up to 3:30/4:30 p.m. (except as otherwise provided herein) shall be paid for at one and one-half times the regular straight time rate of pay. Any hours beyond eight (8) hours worked on Saturday will be paid at double time the regular straight time rate of pay. All work performed after 3:30/4:30 p.m. Saturday to 7:00/8:00 a.m. Monday and on all recognized holidays shall be paid for at double time the regular straight time of pay.
Section 3.04 The following days shall be recognized as legal holidays: New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas Day or days celebrated as such. All holidays that fall on Sunday shall be celebrated as such on the following Monday. Work being performed on holidays and/or designated holidays will receive the holiday rate of pay.
Section 3.05 It is distinctly understood that no construction work shall be done on the first Monday of September, commonly known as Labor Day, except in emergency to preserve life and property and to maintain service to the public.
Section 3.06 Double the regular straight time rate of pay shall be paid for all work performed on the following designated legal holidays, unless definitely stated otherwise on certain specified work: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Day or days celebrated as such.
