Frivolous Complaints and Appeals. UU A frivolous complaint or appeal is one that is objectively unreasonable because it either lacks a factual foundation or is outside the scope of reasons for filing a complaint or an appeal as delineated herein. A frivolous complaint or appeal, additionally, may be one that, although reasonable, is filed with subjective bad faith, e.g., to harass, embarrass, annoy, or waste time or resources.
