Common use of Funding of Initial Costs Clause in Contracts

Funding of Initial Costs. The County of Santa Xxxx has funded certain activities necessary to implement the CCA Program. If the CCA Program becomes operational, these Initial Costs paid by the County of Santa Xxxx shall be included in the customer charges for electric services as provided by Section 5.3.3 to the extent permitted by law, and the County of Santa Xxxx shall be reimbursed from the payment of such charges by customers of the Authority. Prior to such reimbursement, the County of Santa Xxxx shall provide such documentation of costs paid as the Board may request. The Authority may establish a reasonable time-period over which such costs are recovered. In the event, that the CCA Program does not become operational, the County of Santa Xxxx shall not be entitled to any reimbursement of the Initial Costs it has paid from the Authority or any Party.
