Common use of Funds and Funds Management Clause in Contracts

Funds and Funds Management. The Manager shall (a) supervise all disbursements from, and to the extent of the availability of, funds provided by the Owner necessary to pay its debts and obligations and (b) open accounts in the name of the Owner and deposit, withdraw and maintain funds provided by Owner or its members, in banks, savings and loan associations or other financial institutions. The Manager shall not under any circumstances commingle any funds received for the Owner or held for the account of the Owner with the Manager’s or any other Person’s funds.
