Common use of Further Notice to Unitholders Clause in Contracts

Further Notice to Unitholders. In the event that less than all of the Unitholders have surrendered their Units for cancellation within six months after the time specified in the notice referred to in section 14.4, the Trustees shall give further notice to the remaining Unitholders to surrender their Units for cancellation and if, within one year after the further notice, all the Units shall not have been surrendered for cancellation, such remaining Units shall be deemed to be cancelled without prejudice to the rights of the holders of such Units to receive their shares, equally and ratably, of the remaining Trust Property, and the Trustees may either take appropriate steps, or appoint an agent to take appropriate steps, to contact such Unitholders (deducting all expenses thereby incurred from the amounts to which such Unitholders are entitled as aforesaid) or, in the discretion of the Trustees, may pay such amounts into court or to the Public Curator (or other appropriate government official or agency) whose receipt shall be a good discharge and release of the Trustees.
