Furthermore, the Parties undertake to keep confidential all information relating to the negotiation and this Agreement. This undertaking shall not apply if: (i) such information becomes generally available to the public; (ii) such information was available to a third party on a non-confidential basis from a source (other than any of the Parties,) that is not and was not prohibited from disclosing such information to such third party by a contractual, legal or fiduciary obligation; or (iii) a Party must disclose confidential information at the request of a judiciary or fiscal authority in a tribunal to protect its rights. Provided that, however, in case specified in item (iii) above, the Party that become obliged to disclose such information shall deliver to the other Party an previous and immediate written notice, including the disclosed information to the other in a manner that such Party may take all necessary preparations in the defense of its interests.
