Common use of Gas Balancing Agreements and Advance Payment Contracts Clause in Contracts

Gas Balancing Agreements and Advance Payment Contracts. Except as set forth on Schedule 5.18, on the date of this Agreement, on a net basis there are no gas imbalances, take or pay or other prepayments with respect to any of the Borrower’s and its Restricted Subsidiaries’ Mineral Interests which would require the Borrower or any of its Restricted Subsidiaries to deliver, in the aggregate, five percent (5%) or more of the monthly production of Hydrocarbons produced from such Mineral Interests at some future time without then or thereafter receiving full payment therefor.
