Common use of Gatherer’s Right to Minimize Variances and to Balance Clause in Contracts

Gatherer’s Right to Minimize Variances and to Balance. Monthly balancing of Receipt Point volumes and Delivery Point volumes shall be managed by Gatherer so that any Imbalance or tolerance shall be kept as near to zero as practicable. Unless agreed to between parties, Gatherer will not be required to receive quantities from Owner in excess of the quantities Owner or Owner's designee will accept at the Delivery Point(s) on a concurrent basis and Gatherer shall not be required to deliver at any Delivery Point(s) quantities in excess of Equivilent Quantities of the gas received from Owner at the Receipt Point(s).
