General Conditions of Hire. 1.1. The right to use any community facility is subject to the Facility Manager/Booking Officer receiving a completed Hire Agreement Form, signed by the proposed Hirer, agreeing to comply with the Conditions of Hire. Where the Hirer is a community organisation or group the Hire Agreement Form must be signed by a duly authorised member. Where a person signs the Hire Agreement Form on behalf of the Hirer, the person signing the Hire Agreement Form:  Warrants that he or she is authorised to sign the Hire Agreement Form on behalf of the Hirer;  Guarantees that the Hirer will strictly observe and perform the obligations outlined in the Conditions of Hire; and  Agrees to pay to the Facility Manager/Booking Officer on demand, money for any loss suffered by Council due to a breach of the conditions by the Hirer. 1.2. The hire of Council facilities by the community is strictly in accordance with Council’s Community Facilities Hire Policy and the Conditions of Hire herein and does not deem to provide any lasting rights of possession or other tenure over the facility to the Hirer, or confer on the Hirer the rights to exclusive possession or right to sub-let the facility in any manner. 1.3. The Hirer shall be entitled to use only those areas in the facility requested and approved by the Facility Manager/Booking Officer for the purpose and between the hours specified in the Hire Agreement Form. Any use beyond those times may be subject to an additional fee and requires prior approval. 1.4. The Hirer must comply with all requirements and directions given by Council Officers and/or the Facility Manager/Booking Officer when using the facility and Council Officers and/or Facility Managers may enter and remain in the facility at any time. 1.5. Hirers cannot be under 18 years of age. Functions involving persons under the age of 18 years must have the Hire Agreement Form signed by a parent/guardian who will be supervising the meeting/function/party. The person signing the Hire Agreement Form is subject to the General conditions of hire. Functions for the approved purpose of teenage and 21st birthday parties must be supported by a completed Party Safe Registration Form (Victoria Police) and must provide evidence of the engagement of accredited security as a condition of hire.

General Conditions of Hire. 1.1a. The hirer agrees to not sub-hire or allow the hall to be used for unlawful purpose or in an unlawful way, to respect the reasonable needs of others who may be using the Hall’s facilities at the same time and to not publicise their event on the internet, social networking sites or similar. b. Or carry out or permit fly posting or any other form of unauthorised advertisements for any event taking place at the Hall without prior written agreement with the Hall Secretary or other Officer of the Committee. c. Any breach of this condition will result in forfeiture of the hire fee and the hirer will be liable for any claims and proceedings from third parties that may arise from such a breach. d. The committee reserves the right, without giving reason, to decline a booking or use of any equipment belonging to the hall and also reserves the right to cancel a booking in the event of the hall being required for use as a Polling Station, emergency refuge centre or any part thereof being rendered unfit for the use for which it had been hired, the committee shall not be liable to the hirer for any resulting loss or damage whatsoever other than a full refund of any hire fees already received e. At the end of the agreed hire period the hirer must leave the premises and surrounding areas in a clean and tidy condition, properly locked and secured, unless otherwise directed, and any contents temporarily removed from their place be properly replaced f. The committee politely requests that all users of the hall respect the amenities of the village and also be mindful that noise, particularly late at night, is not appreciated by residents g. Fire regulations affecting the hall must be strictly adhered to. Fire extinguishers are available in the hall and a Fire Blanket in the kitchen. The maximum number of people allowed on the premises to accord with Fire Regulations is h. The hall is not licensed for the sale of alcoholic drink and the hirer is responsible for ensuring that any licence(s) that may be required are obtained prior to the event taking place i. There is no refuse collection from the hall and the hire will be responsible for the removal of all refuse and rubbish at the end of the agreed hire period. The committee reserves the right to seek compensation for any costs incurred in the disposal of waste or additional cleaning should this be necessary j. The kitchen may only be used for catering purposes and all utensils, work surfaces and crockery must be left in a clean and fit condition otherwise a charge may be made for cleaning. All hirers must supply their own tea towels etc and it should be noted that Xxxxxx District Council regulations forbid, for safety reasons, children in the kitchen and hirers should discourage children from entering the kitchen. k. The hall is available for hire between 8.00am and 11.00pm and must be vacated no later than 11.30pm. l. Smoking is NOT permitted anywhere within the hall however smoking is permitted within the hall grounds and smokers are asked to use any community facility is subject the receptacle adjacent to the Facility Manager/Booking Officer receiving main door for the disposal of cigarette ends m. The hall holds a completed Hire Agreement Form, signed by the proposed Hirer, agreeing PRS (Performing Rights Society) music licence and hirers planning a disco are requested to comply keep all music at a reasonable level and cease it at 11pm prompt - hirers are advised to liaise with the Conditions Hall Committee before booking a disco or DJ. n. The lighting or use within the hall or grounds of Hire. Where fireworks, barbecues or other types of pyrotechnic device or the Hirer use or erection of bouncy castles or similar equipment is a community organisation or group strictly prohibited for safety reasons and the Hire Agreement Form must be signed by a duly authorised member. Where a person signs terms of our insurance and any breach of this condition will result in the Hire Agreement Form on behalf cancellation of the Hirerhire and any fees paid will be forfeited. The committee shall not be liable for any claims for injuries or damages, however caused, which may arise from the person signing the Hire Agreement Form:  Warrants that he or she is authorised to sign the Hire Agreement Form on behalf use of any of the Hirer;  Guarantees that above-mentioned items either within the Hirer will strictly observe and perform hall or the obligations outlined hall grounds. It should be noted that the hall is equipped with a breach modern RDC electrical circuit breaker which may be tripped resulting in a loss of the conditions by the Hirer. 1.2. The hire of Council facilities by the community power if a faulty appliance is strictly in accordance with Council’s Community Facilities Hire Policy and the Conditions of Hire herein and does not deem to provide any lasting rights of possession or other tenure over the facility connected to the Hirer, or confer on the Hirer the rights power supply and that it may not be possible for power to exclusive possession or right to sub-let the facility in any manner. 1.3. The Hirer shall be entitled to use only those areas in the facility requested and approved by the Facility Manager/Booking Officer restored for the purpose and between the hours specified in the Hire Agreement Form. Any use beyond those times may be subject to an additional fee and requires prior approval. 1.4. The Hirer must comply with all requirements and directions given by Council Officers and/or the Facility Manager/Booking Officer when using the facility and Council Officers and/or Facility Managers may enter and remain in the facility at any time. 1.5. Hirers cannot be under 18 years of age. Functions involving persons under the age of 18 years must have the Hire Agreement Form signed by a parent/guardian who will be supervising the meeting/function/party. Council reserves the right to reject, refuse or veto any application without any right of compensation or other consideration. 1.6. Council or the Club President/Secretary may immediately terminate the hiring of Croydon Tennis Club by the Hirer at any time if the Hirer; • has not provided a current public liability insurance cover, or obtained and paid for an insurance cover with Council; • breaches any of the Hirer’s obligations specified within the Community Facilities Hire Policy or Hire Agreement; • provides any information that is deemed to be false, incorrect or misleading; • is causing a danger to the safety of patrons or the public, undertaking activities that risk loss or damage to property or behaviour that breaches local law or illegal activity. 1.7. Hirers cannot be under 18 years of age. Functions involving persons under the age of 18 years must have the Hire Agreement Form signed by a parent/guardian who will be supervising the meeting/function/party. General Conditions of Hire. 1.11.1 In these Terms and Conditions of Hall Hire, Canterbury Earlwood Caring Association Limited’s Hall is referred to as the hall. 1.2 All individuals or organisations on whose behalf the hire is made (the Applicant) are required to complete a Hiring Agreement and sign the appropriate declaration. 1.3 The Applicant must be twenty one (21) years or older. 1.4 The Applicant shall be entitled to the use of the hall on the dates and during the times indicated in the Application for Hall Hire and pay in accordance with the Association’s Fees and Charges. 1.5 The Applicant must provide the Association with evidence in the form of a Certificate of Currency that they hold valid Public Liability Insurance cover of a least $10 million and confirm with their Public Liability Insurance Company, their planned use of the hall. The right Applicant accepts full responsibility in the event of there being any claims for insurance purposes as a result of their negligence or contributory negligence. The Association will not be held liable. 1.6 No alcohol or tobacco products or any illegal substances are to use be brought onto or consumed in the hall. 1.7 Noise is to be kept to a reasonable limit and the Applicant will not permit behaviour which would cause disturbance or annoyance to adjoining or neighbouring occupiers. 1.8 The Applicant will meet the cost of any community facility is subject damage caused to the Facility Manager/Booking Officer receiving hall or the furnishings and fittings thereof. 1.9 The Applicant will properly clean the hall, including the kitchens and toilets after use to ensure that the hall is left in a completed Hire Agreement Form, signed by the proposed Hirer, agreeing to comply with the Conditions of Hire. A $20.00 deposit will be charged for the hall key, refunded upon its return. 1.13 The Applicant must ensure access is freely available to all stairways, exits, fire escapes and doors at all times. ALL fire exits must be kept free from any obstruction and NOT used as a thoroughfare. 1.14 The Applicant should make themselves aware of the fire exists and positioning of fire extinguishers. They are provided in the hall as a requirement by law for safety measures. Fire extinguishers should only be used in case of an emergency. Misuse of this equipment will result in the discontinued use of the hall. 1.15 The hall shall not be assigned or sublet or used for commercial purposes unless the Association has given prior written approval. 1.16 The Association will hold off on confirmation and acceptance of payment for all bookings of The hall. The hire of Council facilities by the community is strictly in accordance with Council’s Community Facilities Hire Policy Association will assess all applications and the Conditions of Hire herein and does not deem to provide any lasting rights of possession or other tenure over the facility respond to the Hirer, or confer on Hirer within 5 working days from the receipt of the completed application form. The Hirer shall makes a commitment to ensure there is no vilification, discrimination or incitement of hatred or violence against any person or persons based on age, gender, religion, race, ethnicity, culture, sexuality, sexual preference or physical or mental ability by any person attending their event or activity. If the Applicant breaches this condition then forfeit of any payments made for the event/activity/program and be entitled precluded from any future hire of the Association’s premises. 1.18 The Applicant agrees to use only those areas abide by the Association’s Principles and Values. 1.19 The Association reserves the right to refuse any booking and to cancel a booking already made for whatever reason i.e. if the Association decides such cancellation is desirable in the facility requested and approved by public interest or because of a complaint from a member of the Facility Manager/Booking Officer for community etc. With such cancellations, the purpose and between Association will refund the hours specified in the Hire Agreement Form. All fixings must be removed and made good after your event. i) All 20 tables, 110 chairs and the 40 sets of plates, cups and saucers can be used and returned to the place found in a clean and dry state. For larger events you will need to make arrangements for additional crockery and cutlery items. j) ALL young people must be ALWAYS supervised by an adult both inside and outside of the Hall. ALL sports or activity groups where children will NOT be accompanied by a parent/Booking Officer receiving a completed Hire Agreement Formguardian/carer, signed by an up-to-date copy of the proposed Hirerhirer’s DBS clearance must be provided at the time of booking, agreeing to comply with the Conditions of HireTrust’s Safeguarding Policy. Where For use as a venue for activities where children WILL ALWAYS be accompanied by an adult, written clarification to the Hirer is a community organisation or group Hall will suffice. k) The car park has capacity for c.40 cars if managed. The hire of Council facilities by the community is strictly in accordance with Council’s Community Facilities Hire Policy and the Conditions of Hire herein and does not deem to provide any lasting rights of possession or other tenure over the facility to the Hirer, or confer on the Hirer the rights to exclusive possession or right to sub-let the facility in any manner. 1.3. The Hirer shall be entitled to use only those areas in the facility requested and approved by the Facility Manager/Booking Officer for the purpose and between the hours specified in the Hire Agreement Form. Any use beyond those times may be subject to an additional fee and requires prior approval. 1.4. b) The Hirer must comply with ensure that all requirements and directions given by Council Officers and/or leaders/assistants of sessions/functions undertaken pursuant to the Facility Manager/Booking Officer when using hire of the facility and Council Officers and/or Facility Managers may enter and remain in the facility at any time. 1.5. Hirers cannot be under 18 years of age. Functions involving Centre where persons under the age of 18 years 16 will attend have an up to date clear DBS check and must have possess and comply with their own safeguarding policy c) The Hirer must ensure that all leaders/assistant leaders/trainers and/or any coach of a session shall possess a relevant licence/qualification to undertake such a training/coaching session where appropriate. Evidence of qualifications must be provided d) The Hirer shall be responsible for all matters relating to health and safety and shall be wholly responsible for those in attendance during the Hire Agreement Form signed hire. The Hirer must take all reasonable steps to ensure that all attendees of any session/function carried out pursuant to the hire are fully aware of all safety issues relating to the use of the Centre including, but not limited to, fire evacuation procedures and use of any equipment. e) For health and safety reasons all doors including the main entrance must not be wedged open. f) Access to the first-floor rooms is not permitted due to health and safety unless the hire agreement includes use of the upstairs training room (in which case the induction process will include additional health and safety information). g) Attendance at any session/function carried out pursuant to the hire shall be limited to 25 persons or such lesser number of persons which in the reasonable opinion of the administrator can be comfortably and safely accommodated. Attendance at any session/function which takes place pursuant to the hire shall only be permitted where attendees are ticket holders/members of a particular club or organisation or invitees. Persons shall not be allowed to gain access to the session/function by paying on the door. h) The Hirer must take all reasonable steps to ensure that all sessions /functions are carried out in an orderly fashion and do not cause nuisance or annoyance to any other persons or damage to property not owned by the Hirer. The Hirer shall take all reasonable steps to ensure that all attendees of events leave the Centre quietly at the close of the event and shall ensure that any attendee who fails to leave quietly does not attend future events i) Car parking during school hours is limited and priority is given to school staff and visitors. If spaces are available, vehicles must be parked within the white lines and must not block emergency access points. Vehicles are left entirely at owner’s responsibility. The Centre accepts no liability for any damage to vehicles parked on School premises which are parked and left entirely at owner’s risk j) The Hirer must ensure the centre is locked and secured at the end of each session. Ensuring all doors are closed and the alarm system is activated. Any call out of Security or the Centre Administrator, due to user error or misuse, will result in charges being incurred by the Hirer in accordance with the schedule of charges. k) The Hirer is responsible for ensuring the Centre is left in a parent/guardian who clean state at the end of each use. The Hirer will be supervising liable for any additional cleaning costs incurred as a result of a breach of this clause. Repeated breaches of this clause may result in the meeting/function/partytermination of this agreement. Should any additional cleaning costs remain unpaid by the Hirer for a period of 7 days following request, the Hirer shall immediately return any keys to the Centre which they have in their possession. l) All users of the Xxxxxxxx Centre Sports and Arts Hall must take particular care when using the sprung floor. UNDER NO CIRCUMSTANCES MUST HIGH HEELS OR BLACK SOLES BE WORN DURING ANY SESSION WHICH INVOLVES ITS USE. The person signing Centre reserves the Hire Agreement Form right to recover from the Hirer any repair costs arising from a breach of this clause. m) Posters must only be displayed on the notice boards. Any poster deemed, in the reasonable opinion of the administrator, to be offensive will be removed. n) The Hirer or any guest shall not interfere with the gas, electrical or water fittings in place at the Centre. o) Payment of gratuities to any member of the School Governors, School staff or the servants of the Education Authority is subject forbidden. p) The Centre reserves the right to introduce further terms relating to the General conditions of hire. Functions for the approved purpose of teenage and 21st birthday parties must be supported by a completed Party Safe Registration Form (Victoria Police) and must provide evidence hiring of the engagement Centre which shall become effective on giving the Hirer 24 hours written notice of accredited security as a condition of hirethe same.
