General Consideration. 1. The term “vacancy” as used herein refers to an opening designated by BSO management to be filled. Except as modified herein, the Sheriff retains absolute authority to fill vacancies in his sole discretion. 2. A vacancy for the purposes of this section will be limited to changes to shift, hours of work, facility/location and days off within the BSO Division/Unit/Section and shall be filled on the basis of seniority with all qualifications being equal. 3. The Sheriff reserves the right to temporarily fill, for no more than twenty-one (21) calendar days, said vacancy with any available bargaining unit employee after the vacancy arises. 4. This Article does not apply to a BSO Division/Unit/Section wherein all bargaining unit employees within the same classification have the same shift, hours of work, facility/location and days off, inclusive of rotating shifts i.e. CPIS.

General Consideration. (1) Each step in the Grievance Procedure, including any reference to arbitration, shall be taken by such party within the time limits set forth in this article or in Article 7 - Discharge Cases, or the matter shall be advanced to the next step in the Grievance Procedure. General Consideration. Section 1 No paragraph in this agreement shall be in any violation of Civil Service Law, the Rules and Regulations of the State Department of Civil Service; the Rules and Regulations of the Onondaga County Department of Personnel, or any other law, Local, State, or Federal. Section 2 This Agreement shall not abridge any past or present Unit Member monetary benefits unless such benefits are expressly modified by subject within this Agreement. Section 3 In the event that any paragraph of this Agreement shall be determined by a court of competent jurisdiction to be null, void, or unenforceable, such decision shall not affect any of the other provisions of this Agreement, which shall continue in full force and effect. Section 4 When the District establishes new classifications, the rate(s) shall be mutually determined between the District and the Association.
