Common use of GOOD FAITH EFFORT to SETTLE Clause in Contracts

GOOD FAITH EFFORT to SETTLE. The Architect and Owner agree that, upon the assertion of a Claim by the other, they will make a good faith effort to achieve mutual resolution of the Claim. If mutually agreed, the Architect and Owner may endeavor to resolve a Claim through mediation. If efforts to settle are not successful, the Claim shall be resolved in accordance with paragraph D or E below, whichever applies.
